Data protection information of OMQ GmbH

Since the 25th of May 2018, the requirements of the EU General Data Protection Regulation (from now on referred to as the GDPR) apply throughout Europe. In the following, we would like to inform you about the processing of personal data carried out by OMQ GmbH in accordance with this new regulation (see Article 13 GDPR). Please read our privacy policy carefully. If you have any questions, comments, or suggestions about this data protection information, you can send them at any time to the e-mail address given in section 2.

The following data protection information informs you about the type and scope of the processing of so-called personal data by OMQ GmbH. Personal data is information that can be directly or indirectly related to you or can be identified as belonging to you.

The data processing by OMQ GmbH can essentially be divided into two categories:

In accordance with the requirements of the GDPR, you have a number of rights that you can exercise when dealing with us. This includes, among other things, the right to object to selected data processing, in particular, data processing for advertising purposes. The possibility of objection is highlighted in print.

2. Who is responsible for the data processing on this website and how can the data protection officer be contacted?

This data protection information applies to data processing by OMQ GmbH, Chausseestraße 22, 10115 Berlin (“Controller”), and to the following website:

By visiting our website, the browser used on your device automatically sends information to the server of our website and temporarily stores it in so-called log files. We have no control over this. The following information is also collected without your involvement and stored until the automated deletion:

The legal grounds for the processing of the IP address is Art. 6(1)(f) DSGVO. Our legitimate interest follows from the purposes for data collection listed below. At this point, we would like to point out that we are not able to draw any direct conclusions about your identity from the collected data and that we will not do so.

The IP address of your end device and the other data listed above are used by us for the following purposes:

The data is stored for a period of 30 days and then automatically deleted. Furthermore, we use so-called cookies, tracking tools, targeting methods, and social media plug-ins for our website. The exact procedures involved and how your data is used for this purpose are explained in more detail below in Section 3.4.

If you have consented to the so-called geolocation in your browser or in the operating system or other settings of your end device, we use this function to offer you individual location-based services based on your current location. We process your location data exclusively for this function. If you stop using it, the data will be deleted.

3.2.1. Data processing at the time of conclusion of the contract

The object of OMQ GmbH’s activities is the development of artificial intelligence for answering customer inquiries and thus optimizing the topic of customer service in all industries. In this context, we process the data required for the conclusion, execution, or termination of a contract with you. This includes

The legal grounds for this is Article 6 (1) (b) GDPR, i.e. you provide us with the data on the basis of the contractual relationship between you and us. We are also obliged to process your e-mail address due to a requirement in the German Civil Code (BGB) to send an electronic order confirmation (Article 6 (1) (c) GDPR). Insofar as we do not use your contact data for advertising purposes (see 3.3. below), we store the data collected for the execution of the contract until the expiry of the statutory or possible contractual warranty and guarantee rights. Upon expiry of this period, we shall retain information regarding the contractual relationship required by commercial and tax law for the periods specified by law. For this period (usually ten years from the conclusion of the contract), the data will be reprocessed solely in the event of an audit by the tax authorities.

3.2.1. Contact option via the website

The website of OMQ GmbH contains legal requirements which enable quick electronic contact with our enterprise, as well as direct communication with us, which also includes a general address of the so-called electronic mail (e-mail address). If a data subject contacts the Controller by e-mail or by means of a contact form, the personal data submitted by the data subject will be stored automatically. Such personal data submitted on a voluntary basis by a data subject to the Controller will be stored for the purposes of processing or contacting the data subject. No disclosure of this personal data to third parties will take place.

The following statements relate to the processing of personal data for advertising purposes. The GDPR declares such data processing on the grounds of Article 6(1)(f) to be fundamentally conceivable as a legitimate interest. The duration of data storage for advertising purposes does not follow any rigid principles and is based on the question of whether the storage is necessary for the advertising approach. At OMQ GmbH, we also follow the principle of deleting data for advertising purposes after an active request. Please refer to Section 3.3.3 for information on how to proceed in the case of objection.

3.3.1. Interest-based advertising

To ensure that you only receive promotional information that is of supposed interest to you, we categorize and add further information to your customer profile. Statistical information as well as information about you (e.g. basic data of your customer profile) is used for this purpose. The aim is to send you advertising that is geared solely to your actual or perceived needs and, accordingly, not to bother you with useless advertising.

3.3.2. Right to object

You can object to data processing for the aforementioned purposes at any time, free of charge, separately for the respective communication channel, and with effect for the future. For this purpose, it is sufficient to send an e-mail or a postal letter to the contact details mentioned under point 2.

If you object, the contact address concerned will be blocked for further data processing for advertising purposes. We would like to point out that in exceptional cases, advertising material may still be sent temporarily after receipt of your objection. This is technically due to the necessary lead time of advertisements and does not mean that we will not implement your objection. Thank you for your understanding.

3.3.3. Newsletter dispatch via MailChimp

On our website, we offer you the opportunity to sign up for our newsletter. In order to offer you this service, we use the technical service provider MailChimp, a newsletter delivery platform of the US provider Rocket Science Group, LLC (675 Ponce De Leon Ave NE #5000, Atlanta, GA 30308, USA) which helps us to send, process and use your data. MailChimp, as a company based in the USA, is not bound by the same data protection regulations as companies within the EU, but in order to ensure an appropriate level of data protection, we have concluded a “Data Processing Agreement”, a contract in which MailChimp promises to protect the data of our users and to process it on our behalf in accordance with the data protection regulations and, in particular, not to pass it on to third parties. To ensure that no mistakes are made when entering the email address, we use the so-called double opt-in process: After you have entered your email address in the registration field, we will send you a confirmation link. Only when you click on this confirmation link will your email address be added to our mailing list. At this point, the processing of your electronic contact data is based solely on your consent (Article 6(1)(a) DSGVO). You can revoke your consent thus given at any time with effect for the future. To do so, simply send a short note by e-mail to the e-mail address given under point 2 or click on the “unsubscribe” button at the end of each newsletter.

3.4.1. Cookies - General information

We use so-called cookies on our website. Cookies are small files that are automatically created by your browser and stored on your end device (laptop, tablet, smartphone, or similar) when you visit our site. Cookies do not cause any damage to your end device and do not contain viruses, Trojans nor other malware. In the cookie, information is stored that arises in connection with the specific end device used. This does not mean, however, that we gain direct knowledge of your identity. The use of cookies serves on the one hand to make the use of our services more pleasant for you. For example, we use so-called session cookies to recognize that you have already visited individual pages of our website or that you have already logged into your customer account. These are automatically deleted after you leave our site. In addition, we also use temporary cookies for the purpose of user-friendliness, which are stored on your end device for a certain fixed period of time. If you visit our site again to use our services, it is automatically recognized that you have already been with us and what entries and settings you have made so that you do not have to enter them again.

On the other hand, we use cookies to statistically record the use of our website and evaluate it for the purpose of optimizing our offer for you as well as to display information tailored specifically to you. These cookies enable us to automatically recognize that you have already been to our site when you visit it again. These cookies are automatically deleted after a defined period of time. Most browsers accept cookies automatically. However, you can configure your browser so that no cookies are stored on your computer or so that a message always appears before a new cookie is created. However, the complete deactivation of cookies may mean that you cannot use all the functions of our website. The storage period of cookies depends on their purpose and is not the same for all (see below).

If personal data is also processed by individual cookies used by us, the processing is carried out in the case of consent granted in accordance with Art. 6 (1) a) DSGVO and Section 25 (1) TTDSG, insofar as the consent includes the storage of cookies or access to information in the user’s terminal device (e.g. device fingerprinting) as defined by the TTDSG. Otherwise, the processing is carried out in accordance with Art. 6 (1) lit. f DSGVO to protect our legitimate interests in the best possible functionality of the website and a customer-friendly and effective design of the site visit.

On our website, we use the cookies listed in the following table, with the functions also specified there. The storage period of the respective cookies can also be found in the table.

3.4.2. Google Analytics & Optimize

For the purpose of the needs-based design and continuous optimization of our pages, we use Google Analytics, a web analysis service offered by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”) on the basis of your consent (see Article 6(1)(a) DSGVO and Section 25(1) TTDSG). Furthermore, the use of Google Analytics for the purpose of demand-oriented design and continuous optimization of our pages constitutes a legitimate interest within the meaning of Article 6 (1) lit. f DSGVO. In addition, we use Google Optimize on this website. Google Optimize analyzes the use of different variants of websites and helps to improve the user experience according to the behavior of our users on the website. Google Optimize is a tool associated with Google Analytics.

Google Analytics as well as Google Optimize use cookies with a validity of 14 months to collect your access data when visiting our website. The access data is compiled by Google on our behalf into pseudonymous usage profiles and transferred to a Google server in the USA. Before this, your IP address is anonymized. We are therefore unable to determine which usage profiles belong to a specific user. Based on the data collected by Google, we can therefore neither identify you nor determine how you use our website.

In the event that personal data is exceptionally sent to the USA, Google has integrated the EU standard contractual clauses into its terms of use and thus offers a guarantee that the European data protection principles and the local level of data protection are also guaranteed within the framework of data processing taking place in the USA.

Google will use the information obtained through the cookies on our behalf to evaluate the use of our website, to compile reports on website activity and to provide us with other services related to website activity and internet usage. Further information can also be found in the Privacy Policy of Google Analytics. Google Analytics sets the following three cookies for the specified purpose with the respective storage period: “_ga” for 2 years, “_gid” for 24 hours (both to differentiate the website visitors) and “_gat” for 1 minute (to reduce requests to the Google servers)

3.4.3. Smartlook

We use Smartlook, a web analysis tool, on our website. Service provider is the Czech company Smartlook.com, s.r.o., Šumavská 524/31, 602 00 Brno, Czech Republic. You can find out more about the data processed through the use of Smartlook in the Privacy Policy at https://help.smartlook.com/en/articles/3244452-privacy-policy.

3.4.4. Twitter Analytics

We use the analysis tool Twitter Analytics from Twitter, Inc., 1355 Market Street, Suite 900, San Francisco, CA 94103, USA. This analysis tool offers us the opportunity to obtain an overview of the use of our account and its users via the “Twitter Analytics” function. The legal basis for the data processing is our legitimate interest according to Art. 6 para. 1 lit. f) DSGVO and Sec. 25 TTDSG. Our legitimate interest lies in the optimization of our Twitter presence.

In particular, statistical data can be called up and evaluated via Twitter Analytics. We use the data from Twitter Analytics to make the Twitter account as attractive and efficient as possible. For this purpose, Twitter provides us with data that Twitter itself has generated on its own responsibility. The data we receive from Twitter is anonymized data and statistics. Insofar as we receive personal data in this context, we are responsible for our further processing of this data to evaluate the use of our Twitter account. 3.4.5. LinkedIn Insights

This website uses the conversion tool “Linkedln Insight Tag” of Linkedin Ireland Unlimited Company. This tool is used to create a cookie in your web browser. The processing takes place on the basis of your consent in accordance with Art. 6 para. 1 lit. a DSGVO and Sec. 25 para. 1 TTDSG. This tool captures, among other things: your IP address, device and browser properties, and page events such as page views. The data obtained in this way is encrypted and anonymized within 7 days and deleted in anonymous form for 90 days at the latest. Linkedin does not share any personal data with OMQ GmbH. Linkedln only provides us with anonymized reports about the website target group and display performance. In addition, LinkedIn offers the possibility of re-targeting via this tool, which we use. For more information on the use of the re-targeting function, please see 3.4.10.1 . With the help of this data, we have the possibility to display targeted advertising outside our website without identifying you as a website visitor.

3.4.6. Google Tag Manager

This website uses the Google Tag Manager. Google Tag Manager is a solution that allows marketers to manage web page tags through a single interface. The Tag Manager tool itself (which implements the tags) is a cookieless domain and does not collect any personal data. The tool triggers other tags, which in turn may collect data under certain circumstances. Google Tag Manager does not access these data. If deactivation occurs at domain or cookie level, it remains in use for all tracking tags implemented by Google Tag Manager

3.4.7. Make

We use the automation tool Make which is operated by Celonis Inc, One World Trade Center, 87th Floor, New York, NY, 10007, USA 16192.

Make allows us to link various functionalities, databases and tools to our website and synchronize them with each other.

The legal basis for the use of Make is our legitimate interest according to Art. 6 para. 1 lit. f DSGVO. Our legitimate interest here is to integrate the tools used as effectively as possible. If you have given us a corresponding consent for the use, the processing is carried out exclusively on the basis of Art. 6 para. 1 lit. a DSGVO and Sec. 25 para. 1 TTDSG. Any consent given can be revoked by you at any time with effect for the future.

3.4.8. Pipedrive

This website uses Pipedrive, which is operated by Pipedrive OÜ, Mustamäe tee 3a, 10615 Tallinn, Estonia, on the basis of our legitimate interests (efficient and fast processing of user inquiries, existing customer management, new customer business). Pipedrive is a CRM tool for processing and storing contact data. If you contact us (via contact form or e-mail), your data will be processed to process and process your request in accordance with Art. 6 para. 1 lit. b GDPR.

In order to ensure the fastest possible processing of your request, we have connected our contact form with this CRM tool. The data submitted when filling out the form is sent to Pipedrive and stored there on Pipedrive servers. As soon as your request has been processed, the purpose of the storage no longer applies and there are no other conflicting legal exceptions, your data will be deleted in our CRM tool Pipedrive. For this purpose, we have concluded a contract with Pipedrive with so-called standard contractual clauses, in which Pipedrive undertakes to process user data only in accordance with our instructions and to comply with the EU data protection level.

3.4.9. Scheduling Appointments via Calendly

We use the service Calendly (Calendly LLC, 3423 Piedmont Rd NE, Atlanta, GA 30305, USA) to streamline appointment scheduling. Calendly allows you to schedule appointments with us by selecting available times and entering your contact information. Please note that the information you provide will be handled in accordance with Calendly’s privacy policy.

What data we collect:

The information you provide will be exclusively used for appointment scheduling and coordination. Your data will not be used for other purposes and will not be shared with third parties without your consent.

3.4.10. Targeting

The targeting measures listed below and used by us are carried out on the basis of Article 6 (1) (f) DSGVO. By means of the targeting measures used, we want to ensure that you are only shown advertising on your end devices that is oriented to your actual or presumed interests. It is in your interest as well as ours not to bother you with advertisements that are not interesting for you.

3.4.10.1. Re-Targeting

We also use re-targeting technologies from Google, Facebook and LinkedIn. This enables us to make our online offer more interesting and tailored to you. For this purpose, a cookie is set with which interest data is collected using pseudonyms. Based on this information, interest-related advertisements about our offers are displayed on the websites of our partners. No direct personal data is stored and no usage profiles are merged with personal data about you. The cookie is stored for a period of up to 120 days and then automatically deleted.

3.4.10.2. Opt-out option

In addition to the deactivation methods described, you can also generally prevent the targeting technologies explained by making the appropriate cookie setting in your browser (see also 3.4.1). In addition, you have the option of deactivating preference-based advertising using the preference manager available here.

3.4.11. Facebook Pixels

On our website, the so-called “Facebook Pixel” of the social network Facebook, which is operated by Facebook Ireland Ltd, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland (“Facebook”), is used to analyze and optimize our online presence. For these data processing operations, we are joint controllers with Facebook pursuant to Art 26 DSGVO.

The information required with regard to joint responsibility pursuant to Art. 13 (1) (a) and (b) DSGVO can be found in Facebook’s privacy policy. In order to determine the fulfillment of the obligation in accordance with the GDPR with regard to joint responsibility, we have entered into the Controller Addendum with Facebook. For this purpose, it was agreed that Facebook is responsible for the fulfillment of the rights of data subjects in accordance with Articles 15 to 20 of the GDPR with regard to the personal data stored by Facebook after joint processing.

In this context, we would like to point out that within the scope of this service, a data transfer to the USA takes place or such a transfer cannot be excluded. For more detailed explanations, we refer you to our explanations under point 4.

Through Facebook Pixels, it is possible for Facebook to determine the visitors to our website as a target group for the display of advertisements (so-called “Facebook Ads”). For this reason, we use Facebook Pixels to present the Facebook ads placed by us only to those users of Facebook who have also shown an interest in our online offer or have certain characteristics (interest in certain topics or products determined by means of the websites visited), which are transmitted by us to Facebook (so-called “Custom Audiences”). 3.5 Job advertisements/applicant data

From time to time, we advertise vacancies on our website, on our social media channels or via special application portals for which you can apply.

We process the data you have sent us in connection with your application in order to check your suitability for the position (or any other open positions in our company) and to carry out the hiring process.

The legal grounds for the processing of your personal data in this application procedure is primarily Section 26 BDSG or Art. 6 para. 1 lit. b) GDPR. It allows the processing of data required in connection with the decision to establish an employment relationship. Should the data be necessary for legal prosecution after completion of the application procedure, data may be processed on the basis of the requirements of Art. 6 DSGVO, in particular to safeguard legitimate interests pursuant to Art. 6 para. 1 lit. f) DSGVO. Our interest would then consist of asserting or defending against legal claims.

Your application data will be reviewed by the human resources department upon receipt. Suitable applications are then sent internally to the department managers for the respective open position forwarded. The next steps will then be coordinated internally. Within the company, your data will be shared only with those persons who need it to ensure proper handling of our recruiting and hiring process.

In the event of a rejection, applicants’ data will be deleted after 6 months from receipt of the rejection.

In the event that you have agreed to further storage of your personal data, we will add your data to our applicant pool. Your data will then be deleted after two years.

If you are hired, the data will be transferred to our human resources information system.

4. When do we pass on your data to recipients outside the EU?

With the exception of the processing described under point 3, we do not forward your data to recipients located outside the European Union or the European Economic Area. The processing operations mentioned under point 3, result in a data transfer to the servers of the providers of tracking and targeting technologies contracted by us. These servers are located in the USA. The data transfer is based on so-called standard contractual clauses of the EU Commission.

We would like to point out that the USA is not a safe third country in the sense of EU data protection law. US companies are obliged to hand over personal data to security authorities without you as a data subject being able to take legal action against this. It can therefore not be ruled out that US authorities (e.g. intelligence services) process, evaluate and permanently store your data located on US servers for monitoring purposes. We have no influence on these processing activities.

5. What rights do you have over your data?

Under the conditions of Article 21 (1) of the GDPR, data processing may be objected to on grounds relating to the specific situation of the data subject.

The above general right to object applies to all processing purposes described in this Privacy Policy that are processed on the basis of Article 6(1)(f) DSGVO. Unlike the specific right of objection directed at data processing for advertising purposes (compare 3.3.3. above), under the GDPR we are only obliged to implement such a general objection if you provide us with reasons of overriding importance for doing so (e.g. a possible risk to life or health). In addition, you have the option of contacting the supervisory authority responsible for OMQ GmbH, the Berlin Commissioner for Data Protection and Freedom of Information (Berliner Beauftragte für Datenschutz und Informationsfreiheit or BInBDI).

6 How long do we store your data?

The duration for which personal data is stored is determined by the legal retention period in question (for example, commercial and tax retention periods). As a rule, this period is 3 years (e.g. in the case of the regular limitation period for contractual claims) or 10 years (e.g. in the case of tax retention periods). After the expiry of this period, the data in question is routinely deleted so long as it is no longer necessary for the fulfilment of the contract or initiating the contract and/or there is no legitimate interest on our part to store it further.

7 How do we ensure the best possible data security?

All data transmitted by you personally, including your payment data, is transmitted using the generally accepted and secure standard SSL (Secure Socket Layer). SSL is a secure and proven standard, which is also used in online banking, for example. You can recognize a secure SSL connection by the attached s on the http (i.e. https://…) in the address bar of your browser or by the lock symbol at the bottom of your browser.

We also use appropriate technical and organizational security measures to protect your personal data stored with us against manipulation, partial or complete loss and against unauthorized access by third parties. Our security measures are continuously improved in line with technological developments.
